Ponder Fitness LLC (“Ponder,” “we,” “us,” or “our”) operates the ponderfit.com website and the Ponder mobile application (together, the “Service”). This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. By using the Service, you agree to the practices described here.

• Email address when you join our early-access list or subscribe to updates.
• Contact details and message content when you submit a support request or a marketing/partnership inquiry (your name, email, the category of your request, and your message).
• Account information if you create an account in the app, such as your email address and a password (passwords are managed by our authentication provider and stored in hashed form).
• Profile and preference data, including your fitness preferences, workout style, and the ratings and feedback you provide about classes and instructors.

• Usage and device data, such as app interactions, device type, operating system, and log information.
• Approximate location, used to surface fitness classes and studios near you. You control location permissions through your device settings.

With your explicit permission, the app may read certain workout and activity data from Apple Health to help you track progress. We handle this data with particular care:

• We access Health data only after you grant permission, and only for the features you use.
• We do not use Health data for advertising or marketing, and we do not sell it.
• We do not share Health data with third parties except as needed to operate the feature you requested or as required by law.
• You can revoke access at any time in the iOS Settings → Privacy & Security → Health.

• Provide, maintain, and improve the Service and its recommendations.
• Personalize class and instructor matches based on your preferences and ratings.
• Respond to your inquiries and provide customer support.
• Send you product updates and early-access communications you have requested (you can opt out at any time).
• Protect the security and integrity of the Service and prevent abuse.
• Comply with legal obligations.

We do not sell your personal information. We share it only in these circumstances:

• Service providers (sub-processors) that help us operate the Service — for example, cloud hosting and database providers, our email delivery provider, our authentication provider, and our workflow/ automation tools. These providers may process your information only on our instructions.
• Legal and safety reasons, where disclosure is required by law or necessary to protect rights, property, or safety.
• Business transfers, in connection with a merger, acquisition, or sale of assets, subject to this Policy.

We keep personal information for as long as needed to provide the Service and for legitimate business or legal purposes. When information is no longer needed, we delete or de-identify it.

Depending on where you live, you may have the right to access, correct, delete, or export your personal information, to object to or restrict certain processing, and to withdraw consent. California residents have rights under the CCPA/CPRA, including the right to know and the right to delete; we do not sell or share personal information as those terms are defined under California law. To exercise any right, contact us at privacy@ponderfit.com. You can unsubscribe from marketing emails at any time using the link in those emails.

We use reasonable administrative, technical, and organizational measures to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

The Service is not directed to children under 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

We operate in the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above, and material changes may be communicated through the Service.
